I. Basic Provisions
1. The personal data controller according to Art. 4 point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) is AGROEL, s.r.o., ID: 48949302, with its registered office at 9. května 299, Dobrovice (hereinafter: “controller”).
2. Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
3. The controller has not appointed a data protection officer.
II. Sources and Categories of Processed Personal Data
1. The controller processes personal data that has been provided directly by you, or personal data that the controller has obtained based on fulfilling a legal obligation, fulfilling a contract, legitimate and vital interest, or with the consent of the data subject.
2. The controller processes your **identification and contact details** and data necessary for **personalizing content, advertisements, traffic analysis, and fulfilling contracts**.
III. Legal Basis and Purpose of Personal Data Processing
1. Processing of personal data based on the legitimate interest of the controller
In some cases, the controller processes personal data to ensure the protection of its rights and legally protected interests, or the rights and interests of other entities. Such processing may be carried out by the controller without the consent of the data subject. The controller always carefully assesses the existence of a legitimate interest.
2. Processing of personal data based on contractual terms
- Performance of a contract between you and the controller according to Art. 6 para. 1 lit. b) GDPR.
- Legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6 para. 1 lit. f) GDPR.
- Your consent to processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6 para. 1 lit. a) GDPR in conjunction with § 7 para. 2 of Act No. 480/2004 Coll., on certain information society services, in cases where no goods or services have been ordered.
- Processing of your order and performance of rights and obligations arising from the contractual relationship between you and the controller. When ordering, personal data necessary for successful order processing (name, address, contact) are required. The provision of personal data is a necessary requirement for concluding and fulfilling the contract; without providing personal data, it is not possible to conclude or fulfill the contract by the controller.
3. Purpose of personal data processing
- Processing of your order and performance of rights and obligations arising from the contractual relationship between you and the controller. When ordering, personal data necessary for successful order processing (name, address, contact) are required. The provision of personal data is a necessary requirement for concluding and fulfilling the contract; without providing personal data, it is not possible to conclude or fulfill the contract by the controller.
4. Processing of personal data based on the consent of data subjects
The controller processes personal data based on granted consent in cases listed with the controller.
The controller does not engage in automated individual decision-making within the meaning of Art. 22 GDPR.
IV. Data Retention Period
1. The controller retains personal data:
- For the duration of the mutual contractual relationship.
- For the period necessary for the exercise of rights and obligations arising from the contractual relationship between you and the controller and the enforcement of claims from these contractual relationships (for a period of 5 years from the termination of the contractual relationship).
- For the period until consent to the processing of personal data for marketing purposes is revoked, but no longer than 5 years, if personal data is processed based on consent.
2. After the retention period for personal data expires, the controller deletes the personal data.
V. Recipients of Personal Data (subcontractors of the controller)
1. Recipients of personal data are persons:
- Participating in the delivery of goods / services / payment realization based on the contract.
2. The controller does not intend to transfer personal data to a third country or an international organization. Information on the existence or absence of a Commission adequacy decision, or in cases of transfer referred to in Articles 46, 47 or Article 49(1), second subparagraph, reference to appropriate safeguards and the means to obtain a copy of these data or where they have been made available.
VI. Cookies
1. We use "cookies" on our website to provide visitors with greater convenience when Browse. "Cookies" (literally "biscuits") are small text files that websites create on your device when you enter them.
2. Our website uses both "session cookies" and "persistent cookies".

VII. Your Rights
1. Under the conditions set out in the GDPR, you have:
- The right to access your personal data according to Art. 15 GDPR.
- The right to rectification of personal data according to Art. 16 GDPR, or restriction of processing according to Art. 18 GDPR.
- The right to erasure of personal data according to Art. 17 GDPR.
- The right to object to processing according to Art. 21 GDPR.
- The right to data portability according to Art. 20 GDPR.
- The right to withdraw consent to processing in writing or electronically to the address or e-mail of the controller specified in Art. III of these terms, without affecting the lawfulness of processing based on consent granted before its withdrawal.
2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated.
VIII. Conditions for Personal Data Security
1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.
2. The controller has taken technical measures to secure data storage and personal data storage in paper form, especially by means of password, antivirus program, and backups.
3. The controller declares that only persons authorized by it have access to personal data.
IX. Final Provisions
1. By sending an order from the online order form, you confirm that you are familiar with the personal data protection conditions and that you accept them in their entirety.
2. You agree to these terms by checking the consent box through the online form. By checking the consent box, you confirm that you have read and accepted the personal data protection conditions in their entirety.
3. The controller is entitled to change these terms. The controller will publish the new version of the personal data protection terms on its website and will also send you the new version of these terms to your e-mail address that you provided to the controller.
These terms come into effect on May 25, 2018.
